These Terms & Conditions ("Terms") govern your use of the RewardSuite platform and related services (the "Service") operated by RewardSuite ("we", "us", "our").
By registering an account, accessing or using the Service, you agree to be bound by these Terms. If you don't agree, please don't use the Service.
1. Eligibility
Members (end users earning rewards) must be at least 16 years old. If you're under 18, you may only use the Service with the consent of a parent or guardian.
Business Customer admins (operators running the loyalty program) must be at least 18 years old and have the legal capacity to enter into a binding contract under Australian law. If you're using the Service on behalf of a business, you represent you have authority to bind that business.
2. Account registration
You must provide accurate, current and complete information when creating an account. You're responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at hello@rewardsuite.app if you suspect unauthorised access.
3. Business Customer responsibilities
If you use RewardSuite to run a loyalty program for your business, you are the "data controller" of your members' personal information and are responsible for:
- Having a lawful basis to collect, process and communicate with your members
- Publishing your own privacy policy to your members
- Obtaining consent before sending marketing SMS or emails
- Ensuring all rewards, discounts and offers you publish are genuine and legal
- Paying all applicable subscription fees on time
4. Acceptable use
You must not:
- Use the Service for any unlawful, harmful, deceptive or fraudulent purpose
- Attempt to reverse engineer, decompile or probe the Service
- Upload malware, viruses or content that infringes intellectual property
- Send spam or unsolicited communications
- Interfere with or overload our infrastructure
- Use the Service to compete with or replicate RewardSuite
We may suspend or terminate accounts that breach these rules at our discretion.
5. Subscriptions & billing
Paid plans are billed weekly in advance unless stated otherwise. You authorise us to charge your nominated payment method for each billing cycle.
Setup fee. A one-time, non-refundable setup fee of $99 AUD applies to all new Business Customer accounts. This covers onboarding, configuration and initial setup of your loyalty program. The setup fee may be waived at our discretion — for example, during early-access or promotional launches.
Ongoing fees are shown in your chosen currency (AUD or USD). Australian subscriptions are inclusive of GST where applicable.
You can cancel anytime from your account dashboard. There are no lock-in contracts. Your access continues until the end of the current billing period.
Refunds are not generally offered for partial periods or for the setup fee, but we'll consider requests on a case-by-case basis where there's been a material platform outage or billing error.
6. StreamifyBox hardware
If your subscription includes StreamifyBox (in-venue TV signage), a dedicated mini-computer device ("StreamifyBox Device") is supplied and installed at your venue. The following terms apply:
- Refundable deposit: a deposit of $149 AUD is required for each StreamifyBox Device.
- Device ownership: the StreamifyBox Device remains the property of RewardSuite for the duration of your subscription.
- Deposit refund: the full $149 deposit will be refunded upon cancellation of your subscription, provided the Device is returned in reasonable working condition.
- Device return: upon cancellation, you must return the Device within 14 days. Failure to return within this period will result in forfeiture of the deposit.
- Damage or loss: if the Device is returned damaged beyond normal wear and tear, or is lost or stolen, the deposit may be partially or fully withheld to cover replacement costs.
- Use: the Device must only be used as part of the StreamifyBox service. You must not modify, resell or reverse-engineer it.
7. Intellectual property
RewardSuite, its code, design, brand, logos and all related materials are owned by us and protected under Australian and international IP law. We grant you a limited, non-exclusive, non-transferable licence to use the Service while your subscription is active. Nothing in these Terms transfers ownership of any of our IP to you.
8. Your content
You retain ownership of the content you upload — member lists, rewards, booster text, partner discount artwork, etc. You grant us a non-exclusive licence to host, store and display your content as needed to operate the Service.
You're responsible for ensuring you have the rights to upload any content and that it doesn't infringe third-party rights.
9. Third-party integrations
RewardSuite connects with third-party services (e.g. Twilio SMS, Resend email, Cloudinary, Stripe). Your use of those services is subject to their own terms. We aren't liable for outages, changes or data handling by third parties outside our control.
10. Service availability
We aim for high availability but don't guarantee uninterrupted access. The Service is provided "as is" without warranty beyond what's required by the Australian Consumer Law.
11. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claims arising from these Terms or your use of the Service is limited to the subscription fees you paid us in the 3 months preceding the claim.
We are not liable for indirect, consequential, special or punitive damages (including lost profits, lost revenue, loss of data or loss of goodwill) arising from the Service.
Nothing in these Terms excludes any consumer guarantees or rights you have under the Australian Consumer Law that cannot legally be excluded.
12. Termination
You can cancel your account anytime. We can suspend or terminate your access if you breach these Terms, don't pay fees, or use the Service in a way that harms us or other users. On termination, your right to use the Service ends immediately. We'll delete or anonymise your data in accordance with our Privacy Policy.
13. Governing law
These Terms are governed by the laws of South Australia, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of South Australia and the Commonwealth of Australia.
14. Changes to these Terms
We may update these Terms from time to time. We'll notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.
